The reason is because the government wants a cut, once you start collecting money from the players.

If you are hosting a tournament, a good way to avoid any problems is to provide a service for the entry fee. For example, if you want to charge each person $40, provide the players with food, drinks or some souvenir like a hat. This way, you won't be charging them for the service of playing poker, but for the item that you are giving them.
